Special counsel Jack Smith on Wednesday laid out his case for why, even in the face of a Supreme Court ruling that grants presidents sweeping immunity for “official acts,” Donald Trump should be prosecuted for attempting a coup in 2020.
In a 165-page document, Smith makes the case that the then-president did not act in his official capacity when he tried to overturn the result of his election loss to Joe Biden, but rather as a candidate and private person.
The “Motion for Immunity Determinations” painstakingly details how the former president lied and tried to cheat in a desperate effort to cling to power, and it is the kind of document every American should read (and you can do so here).
But it is not just an indictment of Trump, his sociopathy, constant lying, and scheming to stay in office.
It is also an indictment of every Republican official (and voter) who has kept supporting him since the 2020 election.
Yes, there are some new revelations, for example that Trump allegedly reacted to news that his Vice President Mike Pence had to be rushed to a secure location with the words, “So what?”
However, nothing in the motion should come as a shock to anybody. In fact, it would have been more surprising if it had become known that the former president immediately took action to help Pence.
And that is the point.
Everybody knows who Trump is… and his attempted coup culminating in the events of January 6 is just one example.
What sets it apart is that, because it was investigated so thoroughly, it is a very well-documented example.
This is true for all four of Trump’s criminal indictments.
As soon as prosecutors with access to witnesses and subpoena power take a close look at the former president’s actions, they uncover disgraceful behaviors coupled with criminal energy… and all of that is designed to benefit one and only one person.
Let’s assume that even half of the information in the motion turns out to be accurate (and it is so well-sourced that there is no reason to believe that Smith and his team can’t prove all of it in court). Even then, there is ample evidence of abuse of power, obstruction, and criminal activity.
And yet, with all of this being known, nearly the entire Republican party and most of its voters are continuing to march in lockstep behind the former president. That makes it especially commendable whenever a high-profile Republican like former Rep. Liz Cheney, who campaigned with Kamala Harris today, breaks ranks and points out what is so clear to see: Donald Trump is unfit for office.
